I don't understand how they can claim a game as theirs, when it is on a Nintendo Console, and it was developed BEFORE M$ stole the show.

If they can stop Nintendo from making their own game available for purchase through the VC Store, then what stops them from recalling every copy of a RARE game ever produced?

It's not like it's a remake we're talking about here (See Conker Live and Reloaded), it's just a complete copy of a NINTENDO game.
