I don't buy DVD's.

personally, i think no one should be forced to update. but as we all know, some new games will require the latest version of the system for it to work. sony does this with the PSP. sometimes you have no choice but to do an update (bugs and problems can only be fixed by a patched).

who buys dvds anyway? it was just an example i was making.

oh, and i am defying you BB. it's more fun that way.

Why does Nintendo want to disable freeloader? As I understand it, Freeloader simply allows us to play different region games (which must be legit copies, so they're not losing sales). Is this illegal? Why wouldn't Nintendo want people to be able to buy games that they might not otherwise buy (e.g., rare ones or ones not released in Aus)?

I want to get Freeloader but I certainly don't want to get to a point where I have to install an update to play a new game which will make any US region games I buy unplayable. Anyone think that Freeloader will be updated to get around the updates?

Region codes have been challenged by the ACCC in the past. They tend to think it is a violation of sections of of the Trade Practices Act. They have dismissed the concern that console mod chip or software or DVD Player firmware changes that circumvent region restrictions are tools of pirates and hackers. The simple fact they allow you to purchase your legal software/movies from any region in the world is sufficient to legalise the practice.

There has also been discussion about the legality of region codes within the World Trade Organization.

I would think the distributors of Freeloader in Australia could easily mount an anti-competition claim against Nintendo Australia and win as the precedent has already been set when Sony tried to make the PS2 code free chips illegal.

Without EXPRESS PERMISSION any alteration to a system is an illegal act.
The only reason Nintendo have gotten away with it is because nobody has challenged them in a court of law.

They can not simply say we put it on the disk to allow your system to play a certain game if it has any other function.

any unauthorised access to data held in a computer; or
(ii)
any unauthorised modification of data held in a computer; or
(iii)
any unauthorised impairment of electronic communication to or from a computer

Nintendo are not forcing you to update your system. You simply can not play certain games if you do not.

from what i read on the link that only applies to the commonwealth ie government and its about hacking laws

If they wanted you to just be able to play the game then that's all the update would do.
As they put updates on games disks that don't ask permission before updating they've broken the law.

well i guess it si a good thing that they have done it because they are stopping the wrong things from occuring on their consoles now. we cant exactly get angry at nintendo because they care about their consoles being hacked by everyone. they are just securing their own profits better now. i think they will continue to include updates int he games because its either-1. enjoy your hacking OR 2. enjoy our games, and 9 out of 10 times, people will go with option 2.

but all the hackers n stuff of the world will just be irritated for a while and soon get over it because most likely something new will come along and open up a whole new world to the hacking-the-wii-scene.

The law relates to "any access without consent". Which by definition is hacking.

When you put the game disk in it updated your system. It did to me and at no time did it ask "Before you play this game you are required to do a system update. Do you agree. Click Yes to continue"
So translate it into whatever you can understand because as such it may help you make sense in your next post.

Do you know what a license agreement is? Do you know what you clicked yes to when you first got your Wii?

Every single game and system makes you agree to a license agreement because they are all too well aware of the law of consent.

Its when people dont read the fine print they get screwed over.

Are you upset because somewhere along the line you agreed to Nintendo updating your system and you dont remember because you never read it?

Secondly I do have super Paper Mario and other games that update the system. I recall pressing a big fat update button. ie- consent.

I choose for it to be that way.
I didn't consent to any update when I bought the game.
I've never consented to anything Nintendo have asked of me.
