After losing a bid to overturn a US$21 million patent-infringement verdict against Anascape Ltd., Nintendo is facing a ban on sales of the Wii Classic Controller and standard and Wavebird versions of the GameCube controller in the US, it's been reported.
The ban is scheduled to be issued today by US District Judge Ron Clark in Lufkin, Texas, and Nintendo will have to post a bond or put royalties in an escrow account to avoid it.
Nintendo spokesman Charlie Scibetta said "Nintendo was already planning to appeal this case to the Federal Circuit court," and that "The recent ruling by the trial court does not impact that decision."
Once Anascape's order has been submitted, Nintendo will "immediately appeal" and post a bond said Scibetta. He said that Nintendo no longer makes the GameCube controllers, and "is free to continue selling the Wii Classic Controller" pending the appeal.
Fortunately for Nintendo, jurors agreed that its Wii Remote and Nunchuk controllers don't violate the patent at the heart of the case - owned by inventor Brad Armstrong - which covers certain configuration to control six types of motions at the same time.
