Based on Common law - you are allowed to put a modchip which circumventes the region encoding on the console, ie allow one to play games from another region. If the console is region-free no modchip is legal. This is the current position of the law in Australia. [forgot which level of court this was pronounced in]. If it was the high court then its applicable for all of Australia, if it was in supreme then only in that state/territory.

In regards to statute, i have not done my research if the common law has been overridden.

Well that's the whole argument. You are allowed to install a modchip into any console according to Australian law. As for the actual console companies and what they can do, it's a little grey...

I'm pretty sure that was from the High Courts of Australia, so applies to all of Australia.

You can only install a modchip to get around region locks. If a console was region free then the chips is illegal. to my understanding anyway. As for nintendo "bricking" your wii i dont think they could get away with it. They can stop you using their online services though.

I didnt realise spyke already posted this. opps.

Nintendo cannot legally brick your Wii since it's a sad loophole in Australian law that legalises Modchips. Modchips are perfectly legal, but more to the point, modding your Wii to play overseas games is perfectly legal. These dodgy chipping companies have found a loophole that allows the to make a chip that allows playing of overseas AND burnt/downloaded games. I would have no problems with chipping the Wii if the chip ONLY bypassed region coding. Intead half the ****** on this site see fit to download the games, robbing developers of thier income and leaving them with less money to make better games in the future. I also have a massive legit DVD collection too. My advice: Don't mod the Wii, buy games legit, and learn a little patience (most kiddies on this site didnt learn that from thier mummys) and wait for a local release.

Really?
How would you configure the modchip to only allow that? You could do it via DVD, how would your DVD read a DVD you burn..?

Thats right, you need a modchip that allow non Nintendo licensed discs to run.

You can't really have one without the other when you need to exploit the same thing to do one of them.

In that new set of conditions that nintendo released, it says somewhere that they have the right to brick your wii UNTIL THE MODCHIP IS REMOVED. Which means that there is a way to recover your console when it is bricked.

Guys, if you have just recently chipped your Wii and you have been using the "Everybody Votes" channel, you may need to delete your save file for it as there will be problems with the channel when you go to run it. The main, obvious problem is the time duration till the end of the poll, which usually shows 100days after the Wii has been chipped!

It's not all about paitence Foetoid, just some of us prefer paying only $40 for a new game as opposed to double that (or more) for a local release

I have had no problems since getting mine chipped (except the Everybody Votes glitch, but it's just the Everybody Votes Channel....), If you do it right you will have no problem.

I was just wondering what risks there are of bricking..

I read that playing NTSC games can brick it. As long as I dont brick my Wii in this way will it be ok?

The sleep mode thing seems pretty safe. I was also wondering if in the past chips have stopped working before? This is the first time I have considered getting a console chipped and I was interested.

Yes, it's ok. Just take the appropriate precautions(wiibrickblocker, etc) when running games that are of NTSC region.

I just deleted the save file and I think the channel and started over again. This is because the battery was removed when installing the chip.

In my opinion you are not a true Nintendo supporter if you steal games from Nintendo.
Yes it sucks how we have to wait to get games but if you want to import games either get them from the UK or wait because there wont be new games anymore if more people decide to steal.
Thats just my opinion but each to there own.

MugaHay said: Well you are fine to say that with the stealing part, that is your opinion. However what do you say about modding the Wii and buying US games? You don't have to steal if you mod, there are a few NTSC games that work.

I think its ok if you pay full price for a game whatever region it is(which means you have to mod your Wii) but downloading a game you do not own or copying a game that you do not own is a different story.
Its one of those boarderline things.

Its boaderline as in 1 side of the line it is legal to backup something that you own but on the other side it is illegal to backup something that you do not own.

You can always take the chip out if nintendo are able to block you via wifi network connection in the future.

My 2cents: If you assume you can download any game any time and months in advance before they are released in australia, try downloading 1 first. They are all 4.2GB, and only a few games are well seeded.
But hiring games and making your own back-ups with the LG dvd is would be good. Hiring also includes returning bought games from EB on a regular basis

I just called some dudes in Bankstown that work and its $50 to clean up and re-install with the mess I made. I would've gone with OzModChips but the thought of Posting my Wii out gave me the Chills. At least with this I can go and see it done in front of me.
